Last night, I read a bunch ofÂ posts in the blogosphere and then watched a segment on MSNBC’s Keith OlbermanÂ talking about the Congressional Review Act of 1996 (CRA) and how it could be used to undueÂ regulations issuedÂ in these final weeks ofÂ the Bush Administration.Â Some people seem to be chomping at the bit thinking that the CRA is the answer to their disdain for Bush’s policies.Â In the short term, they mayÂ be satisfied, but in the longÂ term, the CRA is bad public policy.Â That’s the debate that I wishÂ was taking place.Â
Back to Basic Civics 101.Â The Congressional Branch passes laws and delegates authority to the Executive Branch and its federal agencies.Â If we look at OSHA, for example, its broadÂ authority toÂ regulate hazards that kill and injure workers comes from the OSH Act of 1970—a law that Congress passed.Â If regulated parties believe they are harmed by OSHA’s regulatory action, they have rights to seekÂ judicial review in theÂ Judicial Branch and there are other remedies offeredÂ through theÂ Executive Branch.
When President Clinton signed the “Small Business Regulatory Enforcement Act of 1996,”Â I thought it was a terrible law.Â A vast majority ofÂ Congressional Dem’s endorsed it, ignoring the fact (HELLO!)Â that it wasÂ an outgrowth ofÂ the Newt Gingrich-led “ContractÂ on with America.”Â TwoÂ major provisions in this 1996 law were the CongressionalÂ Review Act and SBREFAÂ panels.Â (Yuck! and Yuck!)Â
The SBREFA provisionsÂ mandate that OSHA (as well as EPA) add a whole new step in the rulemaking process — the SBREFA panels—which further delay the snail’s pace for issuing more protective workplace standards.Â (Frankly, I object to the notion thatÂ small businessesÂ have some special status when it comes to rulemaking.Â If anyone deserves special status, it’s theÂ WORKERS.)Â TheÂ SBREFA process inappropriately givesÂ small businessesÂ the right to influence the content of the proposed rule, in advance ofÂ any other interested party.Â Â Â Â
The SBREFA part of theÂ ActÂ is bad enough, but then add on theÂ Congressional Review Act, and this 1996 has beenÂ a disaster for worker protection standards.Â Â Think of it this way: if OSHA manages toÂ jump through the small business hurdles and objections (empowered by SBREFA)Â to get out an OSHA health or safety standard,Â at the end of the day, a misinformed or misguided Congress has the power toÂ kill the rule in a snap using theÂ Congressional Review Act.Â (Then off to the President for signature or veto.)Â Â Â Â
Let’s revisit the most famous use of the Congressional Review Act and see if we really think giving this authority to CongressÂ was a good idea.
OSHA and other government scientistsÂ spent nearlyÂ a decade developing aÂ standard toÂ reduce workers’ risk of developing musculoskeletal disorders (MSDs).Â Â The authority for developing this rule was delegated byÂ CongressÂ by the OSH Act of 1970.Â Â AfterÂ scads of public meetings, public hearings, comments onÂ pre-proposal drafts, comments, comments & more comments (see Chronology hereÂ )Â Â —and thenÂ loads of industry-backed shenanigansÂ implemented through congressional appropriations riders—a final rule to protect workers from MSD’s was published onÂ November 14, 2000. The effective dateÂ was January 1, 2001.Â
These PREVENTABLE musculoskeletal injuries cause substantial harm each year to 600,000 workers and their families, andÂ cost the economy annually $20 Billion.Â Â Opponents of OSHA’s ergonomic regulation might not have liked what the scientific evidence revealed, but it is what it is:Â Ergonomic hazards pose a significant risk to workers’ health AND there are feasible means to reduce these risks.
Just two months later, aÂ new Congress comes to town, including 12 freshman Senators and 39 freshman congresspersons.Â Â Many were ridingÂ in on GW Bush’s coattails.Â Â
They were sworn in,Â counted some Electoral College votes on January 6 (G.W. Bush won), and then adjourned until January 20 when their legislative days really began.Â Â On March 6, resolutions were introduced in the House (H.J. Res 70, introduced by Linder (R-GA)) and the Senate (S.J. Res 6, introduced by Nickles (R-OK)) to “disapprove” of OSHA’s ergonomics rule.Â The resolution passed both chambers of Congress and President Bush signed it into law on March 20, 2001.Â Just like that, years of effort to prepare a rule to protect workers occupationally-related musculoskeletal disorders is obliterated.
What the heck did the Members of Congress who voted to “disapprove” of OSHA’s rule, really knowÂ about the scientific evidence related to ergonomic hazards and injuries, and the practical means to prevent them?Â Â Certainly not more than OSHA’s scientific and public health experts who spent tens of thousands of hours studying, analyzing and discussing it.
From a soundÂ public policy perspective, is it wise for us allow Members of CongressÂ (who haveÂ no scientific expertise on the matter) to have power to wipe out a rule like OSHA’s ergonomics standardÂ in a matter of minutes with an up or downÂ vote??Â Â Talk about political interference in agency science.Â Â
Back toÂ U.S. Civics 101: Congress created OSHA to be this expert body, and interested parties have rights within the OSH Act and other administrative laws to participate in and influence the content of OSHA’s rule.Â And, if interested parties believe they are harmed, they have remedy in the Legislative Branch.
Another very troubling part of the CRA isÂ Section 801(b)(2) says that if a rule is “disapproved” under the CRA, the agency:
“…may not be reissued in substantially the same form, and a new rule that is substantially the same as such a rule may not be issued, unless the reissued or new rule is specifically authorized by a law enacted after the date of the joint resolution disapproving the original rule.”
So I guess before worker advocates begin advocating for rules to protect workers from MSD’s, we better ask Members of Congress to undue what they did using the CRA.
TheÂ descriptions of the CRA that I’ve been reading and hearing over the last week suggest erroneously that the law wasÂ especially designed to allow Congress to undo regulations issued by anÂ outgoing Administration in its final weeks.Â Â Not so.Â TheÂ law gave Congress theÂ mechanism to review and disapprove agencies’ rules,Â no matter when they are issued.Â Â That’s aÂ HUGE public policyÂ issue that should be talked about.Â
Let’s review the highlights lowlights ofÂ the Congressional Review Act of 1996 (CRA):
The CRA requires agencies to send a report to Congress about all major rules (i.e., impact on economy of $100 million or more) at least 60 days before the proposed effective date.Â This mandatoryÂ report mustÂ include, among other things,Â a copy of the rule and the regulatory (economic) impact analysis.Â The report is referred to theÂ House and Senate committees with jurisdiction over the agency.Â
The CRA specifically states that a rule cannot take effect if the report is not submitted to Congress.Â There are exceptions however, such as, if the agency finds “good cause that notice and public procedures thereon are impractible, unnecessary, or contrary to the public interest,” or if the President determines that a rule should take effect because of imminent threat to health or safety or other emergency.
Congress, in passing the CRA, gave ITSELFÂ a 60 dayÂ period to review final agency regulatory action.Â For those who suggest that theÂ law was especially designed to give Congress the power to strike down regs issued in anÂ Administration’s final months, I believe that it has more to do with Congress’ history of being out of session between a Presidential Election and Inauguration Day.Â Â The law granted them theÂ 60 day review period, but if they are out of session for 10 weeks between November and January 20, they wouldn’t be able to exercise their review power.Â It’s for this reason that this provision was included in the CRA:
Section 802(e)(2) if the report under section 801(a)(1)(A) was submitted during the period referred to in section 801(d)(1), after the expiration of the 60 session days beginning on the 15th session day after the succeeding session of Congress first convenes.
It accomodatesÂ Members of Congress’ traditional absence during November, December and January.
The resolutions “disapproving” an agency’s rule are not remarkable.Â The one killing OSHA’s ergonomics standard read:
“Resolved by the Senate and House of Representatives of the United States of America in Congress assembled, That Congress disapproves the rule submitted by the Department of Labor relating to ergonomics (published at 65 Fed. Reg. 68261 (2000)), and such rule shall have no force or effect.”
Period.Â End of story.
Researcher Morton Rosenberg of the Congressional Research Service has written several reports on Congress’ use of the CRA.Â In hisÂ 2008 report, “the Congressional Review Act after a Decade,” he lists about 50 times that resolutions were introduced by Members of Congress who attempted to use the CRA to “disapprove” an agency rule.Â Only once–OSHA’s Ergonomics Rule—did Congress succeed in nullifying a regulation.Â That was a terrible blow to protecting the health of our nation’s workers.
If we examined the 50 other regulations that were targets of theÂ CRA but not “successfully” nullified,Â I bet in most cases, the interests groups and their supporters in Congress used a variety of the other administrative and judicial avenues to challenge these rules.Â TheseÂ measuresÂ exist and have been used masterfullyÂ for decades.Â
Using the CRA might satisfy interest groups short-term desires, but in the long-run (and for me, when the political tables are turned) the CRA is bad public policy.Â Just ask workers and public healthÂ advocates who fought for decades for a rule to reduce injuries from ergonomic hazards.Â The CRA sucks!

I watch Olberman but I’m afraid he smack me down. He can be pretty harsh on people who correct him. He might even say that I’m bitter about something that happened 8 years ago and I should get over it. The CRA will serve a purpose today, and that’s what I should care about.

I guess I don’t understand your beef. Congress has the power to overturn a regulation with or without the CRA. The CRA just provides a procedure to do it. Also, I think this sentence is confused:

Judicial review occurs, by definition, in the judicial branch, not the legislative branch. What are the “other remedies offered through the Executive Branch” you are referring to?

My perspective comes from my 11 years working in regulatory agencies in the Executive Branch. I believe there are numerous opportunities for interest groups to influence the content of regulations, some of which are given by the APA and others through procedures and practices set up by the agencies, the Cabinet Secretaries, SBA and OMB.

So, then, as I’ve asked here before, WHY do we continually beat up the OSHA administrators for failing to implement new regulations? It’s pretty hard for anyone to make progress when they are under a stranglehold. And, you failed to mention, that IF OSHA can sneak something past the Congress, they will be immediately shown the door to the courthouse to face the labor and industry groups, each claiming the new regulation is not protectivie enough and too restrictive (respectively).
I saw some pundit a couple of days ago predicting that Jordan Barab might get tagged to be the new Asst. Secy of Labor for OSHA. I think that would be fantastic – not only is he a strong advocate for the worker, but it would also be a great test for us to see – is it (a) OSHA that’s dragging its feet, or is it (b) everyone else who has their finger on the “kill switch.” I’m going with “b”, and I’m betting even Jordan couldn’t loosen the congressional stranglehold. I hope I’m wrong.

As far as the use of CRA, in its only successful use we see what it did to workers, 10 years down the drain in a matter of days. Business lied over and over about the ergo standard, as far as they are concerned any regulation of business is bad, not matter how good it is, even for the regulated businesses. To wit, 3M corporation, knowing an ergo standard was comming, started an aggressive ergo program in all their facilities in this country. After a couple years their workers comp premium had gone from roughly three and one third million a year to one point one million. Yet all the big business lobbies had proclaimed that the standard would cost billions and put all the small “mom & pop” companies out of business. Someone explain to me how saving a ton of money will put you out of business.
